Broken R Holdings, LLC Intellectual Property Series (“KinetaIQ,” “we,” “us,” or “our”) operates the Facility Operator Diagnostic available at kinetaiq.com. This Privacy Policy explains what information we collect when you use the diagnostic, how we use it, and what rights you have regarding your information.
By completing the Facility Operator Diagnostic, you agree to the data practices described in this Privacy Policy.
We collect your first name, last name, email address, phone number (if provided), facility name, and number of coaches at your facility. This information is submitted at the beginning of the diagnostic and is used to create your operator record and contact you about your results.
We collect your answers to the diagnostic questionnaire, which includes up to 21 core and adaptive diagnostic questions, 7 background questions collected inline during the diagnostic, and 6 post-diagnostic intake questions collected after your results are displayed. These answers are used to compute your diagnostic score and generate your results.
We collect and store your composite diagnostic score, individual engine scores across the six operational dimensions, estimated revenue gap and time gap calculations, top leak category classifications, routing classification (whether your results indicate readiness for immediate outreach or a nurture sequence), and the list of adaptive branches triggered during your diagnostic session.
If you arrive at the diagnostic through a tracked link, we collect UTM parameters including source, medium, campaign name, and content identifier. These parameters are captured automatically from your URL when you visit the diagnostic landing page. You do not enter this information directly.
We use your contact information and diagnostic results to deliver your results, follow up with you about your performance gaps, evaluate your application for the KinetaIQ pilot program, and conduct a review call if your application is accepted.
We use diagnostic response data to improve the accuracy of the diagnostic scoring engine, calibrate benchmark scores, and develop new features within the KinetaIQ platform.
We use anonymized, aggregated diagnostic response data — data that cannot be used to identify you or your facility individually — to compute and publish industry benchmark scores. When you complete the diagnostic, your anonymized responses contribute to the benchmark dataset. The benchmark data and all derived analyses are owned exclusively by KinetaIQ.
You grant KinetaIQ a perpetual, irrevocable, royalty-free license to use your anonymized, aggregated diagnostic response data for benchmarking, product improvement, and research purposes. This license survives any deletion of your individually identifiable information.
We use UTM parameter data to understand which marketing channels are driving operators to the diagnostic. This information is used internally for marketing planning and is not shared with third parties.
We retain your contact and facility information, diagnostic response data, and diagnostic results for 24 months from the date of your diagnostic completion, or until you request deletion, whichever comes first. After this period, your individually identifiable information is deleted from our active systems.
Anonymized, aggregated benchmark contributions are retained indefinitely as part of the benchmark dataset. Anonymization is irreversible — once your data has been anonymized and aggregated into the benchmark, it cannot be extracted or deleted.
Backup copies of your data may persist for up to 90 days after deletion from active systems, after which they are purged from backup storage.
We do not sell your personal information to third parties.
We use Google Firebase (a Google Cloud service) to store and process diagnostic data. Firebase operates as a data processor under our instructions.
We use Google Workspace to deliver follow-up communications related to your diagnostic results and pilot application. We share your email address and name with Google Workspace for this purpose. Google Workspace operates as a data processor under our instructions.
KinetaIQ operates an SMS messaging program to deliver transactional and service-related messages to contacts who have explicitly opted in. These messages include appointment reminders, session confirmations, athlete development progress updates, coaching check-ins, and program notifications.
Opt-in: You may opt in to receive SMS messages from KinetaIQ by providing your mobile phone number and checking the SMS consent box on our intake forms, or by texting a keyword to our designated number.
Opt-out: You may opt out of SMS messages at any time by replying STOP to any message you receive from us. After opting out, you will receive one confirmation message and no further SMS messages will be sent.

Message frequency: Message frequency varies based on your program activity and appointment schedule.
Message and data rates may apply based on your mobile carrier plan.
Non-sharing statement: Mobile opt-in data and consent will not be shared with any third parties for their own marketing purposes. Your mobile number and SMS consent status are used solely to deliver the KinetaIQ SMS program described above.
We do not share your diagnostic response data, results, or facility information with any other third party, including advertisers, data brokers, or analytics platforms, except as required by law.
You have the right to request access to the personal information we hold about you and to request correction of any inaccurate information.
You have the right to request deletion of your personal information. Upon a verified deletion request, we will delete your individually identifiable information from our active systems within 30 days. Note that deletion of individually identifiable information does not affect anonymized, aggregated benchmark contributions, which are retained as described in Section 3.
You have the right to request a copy of your personal information in a portable format.
You may opt out of follow-up communications from KinetaIQ at any time by following the unsubscribe instructions in any email we send you or by contacting us directly at the address in Section 7.
To exercise any of the rights described above, contact us at privacy@kinetaiq.com with the subject line “Privacy Request” and a description of your request. We will respond within 30 days.
The Texas Data Privacy and Security Act, effective July 1, 2024, provides Texas residents with rights regarding their personal data. If you are a Texas resident, the rights described in Section 5 of this Privacy Policy are available to you under the TDPSA. To submit a request under the TDPSA, use the contact information in Section 7.
The California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA) may provide California residents with additional rights regarding their personal information. KinetaIQ’s diagnostic collects information from business operators in a business-to-business context. The CCPA includes a B2B exemption for personal information collected in the context of a business relationship.
